Is Ukraine about to simplify getting work permits for foreigners?
The Ukrainian Cabinet of Ministers has approved a new order of employment of foreigners and stateless persons. It aims to protect the internal employment market from non-qualified workforce, and to decrease the number of necessary permissions.
That implies the company to employ a non resident should obtain an official work permit from the local employment centre. The paper will be given on condition of absence of unemployed of respective qualification in the employment service’s register. Besides, it was envisaged that issuing of such permission was paid and made up 4 minimal wages (from January 1 of the current year a minimal wage is UAH 1147).
The experts consider the amendment is not employer friendly and is likely to complicate foreigners' employment procedure.
The positive side of the amendment is that compared to the previous order issuing of the permission has been simplified. The number of documents handed over by the employee has been shortened from 15 to 8, the term of considering the documents by the State Employment Service has been cut from 30 to 15 days. At the same time, the term of validity of such permission remained unchanged – up to 1 year.
Such permission is not needed for employment of foreigners who constantly reside in Ukraine. Besides, it is not needed also for foreign media representatives, sportsmen, actors and artists, employees of rescue services, employees of foreign representatives, foreigners who came to Ukraine to participate in implementation of projects of international technical assistance and performing education activities in the specialty in the state higher educational institutions.
